The Website provides general information about our company, products, window and door systems, project experience, technical capabilities, manufacturing process, importing, delivery, and related support.

2. Scope of Our Business

PRO Windows & Doors specializes in the supply and delivery of custom European window, door, sliding, and facade systems.

Unless expressly stated in a separate written agreement signed by an authorized representative of PRO Windows & Doors:

We do not provide installation services;

We do not act as a general contractor;

We do not assume responsibility for construction means, methods, sequencing, jobsite safety, permits, inspections, or supervision;

We do not provide architectural, structural-engineering, or legal services;

We do not guarantee approval by an architect, engineer, municipality, homeowners association, or other authority.

Customers are responsible for hiring qualified professionals to install the products and verify applicable project requirements.

3. No Contract Formed Through Website Use

Accessing the Website, submitting a contact form, requesting an estimate, uploading documents, communicating with our team, or receiving preliminary information does not create a contract, customer relationship, partnership, agency relationship, or obligation to supply products.

A purchase or other binding transaction exists only when documented through an applicable written proposal, quotation, invoice, order confirmation, purchase agreement, or other written instrument accepted by the parties.

Any transaction-specific document may contain additional or different provisions concerning:

·  Deposits and payment

4. Quotes and Estimates

Quotes may be based on information provided by the customer or another project participant and may change because of:

Manufacturer price changes;

Freight, fuel, customs, tariff, brokerage, or insurance costs;

Taxes;

Errors or omissions.

We may correct pricing, product, calculation, typographical, or clerical errors before an order is formally accepted.

5. Custom Products and Order Approval

Most products supplied by PRO Windows & Doors are custom-manufactured for a particular project.

Customers are responsible for carefully reviewing and approving all applicable order information, including:

Dimensions;

Quantities;

Opening directions;

Handing;

Configurations;

Frame systems;

Glass specifications;

Tempering and safety-glazing locations;

Colors and finishes;

Hardware;

Screens;

Thresholds;

Accessories;

Performance requirements;

Shop drawings or order confirmations.

Once an order has been approved and released for production, modifications, cancellations, refunds, or returns may be unavailable or may result in additional costs. Applicable terms will be stated in the written proposal, order confirmation, invoice, or purchase agreement.

PRO Windows & Doors is not responsible for errors contained in dimensions, plans, schedules, drawings, specifications, approvals, or other information supplied or approved by the customer or another project participant.

6. Measurements and Opening Conditions

Unless field-measurement services are expressly included in a written agreement, the customer is responsible for providing and verifying all dimensions.

Any review performed by PRO Windows & Doors is intended to assist with product coordination and does not transfer responsibility for the accuracy of measurements or the suitability of existing or proposed openings.

The customer and its installer or contractor are responsible for verifying:

Rough-opening dimensions;

Finished-opening dimensions;

Wall thicknesses;

Sill and threshold conditions;

Structural support;

Waterproofing and flashing;

Clearances;

Installation tolerances;

Interior and exterior finishes;

Accessibility;

Compatibility with surrounding construction.

Changes to construction conditions after final approval may require product modifications or replacement at the customer’s expense.

7. Building Codes, Permits, and Professional Review

Product systems may have testing, ratings, reports, or performance data available for particular configurations. Performance may vary based on unit size, glass, reinforcement, hardware, assembly, installation, exposure, and other project conditions.

Unless expressly stated in a signed written agreement, PRO Windows & Doors does not represent or warrant that any particular product:

Satisfies every applicable law, code, ordinance, or regulation;

Is suitable for every climate zone, exposure, opening, or building type;

Will be approved by a particular municipality or authority;

Meets project-specific structural, energy, acoustic, fire, egress, impact, safety-glazing, historic-preservation, or accessibility requirements.

The property owner, architect, engineer, contractor, installer, and other project professionals are responsible for determining applicable requirements and obtaining all permits and approvals.

Any technical information supplied by PRO Windows & Doors must be reviewed and approved by the appropriate licensed project professionals and authorities having jurisdiction.

8. Product Information and Website Images

We make reasonable efforts to present product information accurately. However, products, options, technical specifications, hardware, accessories, colors, finishes, glass appearances, and availability may change.

Website images, digital renderings, photographs, brochures, samples, and monitor displays may not precisely represent the final product. Differences may occur because of:

Lighting;

Photography;

Screen settings;

Material variations;

Manufacturing tolerances;

Glass reflections;

Batch differences;

Supplier or manufacturer updates.

Website content should not be used as the sole basis for final product selection. Final specifications must be confirmed in the applicable order documents.

9. Manufacturing and Lead Times

Manufacturing, freight, customs, and delivery timeframes are estimates unless expressly guaranteed in a signed written agreement.

Estimated schedules may be affected by circumstances outside our reasonable control, including:

Manufacturer production schedules;

Supplier delays;

Port congestion;

Customs inspections;

Freight-carrier delays;

Weather;

labor disruptions;

Transportation interruptions;

Governmental actions;

International events;

Force-majeure events;

Changes requested by the customer;

Late approvals or payments.

PRO Windows & Doors is not responsible for construction delays, labor costs, lost profits, temporary protection, storage costs, financing expenses, penalties, liquidated damages, or other losses resulting from an estimated manufacturing or delivery date unless specifically accepted in a signed written agreement.

10. Delivery, Access, and Unloading

Delivery terms will be identified in the applicable proposal, invoice, order confirmation, or purchase agreement.

Unless otherwise agreed in writing, the customer is responsible for ensuring that the delivery location:

Is legally and safely accessible to the delivery vehicle;

Has sufficient clearance and stable access;

Is ready to receive the shipment;

Has appropriate personnel and equipment available for unloading;

Has a safe, dry, protected storage area;

Complies with applicable site and safety requirements.

The customer may be responsible for cranes, forklifts, lifts, loading docks, street permits, traffic control, union labor, flaggers, escorts, redelivery, waiting time, detention, storage, or specialized handling.

PRO Windows & Doors and its carriers may decline to enter or unload at a location reasonably considered unsafe, inaccessible, or unsuitable.

11. Inspection After Delivery

The customer or its authorized representative should inspect delivered products promptly.

Visible shortages, damage, or packaging concerns should be documented at delivery whenever reasonably possible, including through photographs and written notation on the carrier’s delivery documentation.

Concealed damage, missing components, or product concerns should be reported to PRO Windows & Doors promptly after discovery and before installation, modification, disposal of packaging, or corrective work.

Failure to inspect or provide timely documentation may affect the ability to pursue a freight, manufacturer, insurance, or warranty claim.

The customer should not install a product that is visibly damaged, materially incorrect, or reasonably suspected to be defective without first notifying PRO Windows & Doors.

12. Installation by Others

Products must be installed, adjusted, glazed, sealed, flashed, anchored, and maintained by qualified professionals according to:

Manufacturer requirements;

Approved project documents;

Applicable building codes;

Accepted construction practices;

Project-specific conditions.

PRO Windows & Doors is not responsible for installation performed by the customer, contractor, installer, subcontractor, or another third party.

Warranty or claim coverage may be denied or limited for damage or performance issues caused by:

Improper installation;

Incorrect anchoring;

Inadequate flashing or waterproofing;

Improper foam, sealant, fasteners, or materials;

Structural movement;

Out-of-square or unsuitable openings;

Jobsite damage;

Unauthorized modifications;

Failure to follow manufacturer instructions;

Improper storage, handling, cleaning, adjustment, or maintenance.

13. Warranties

Products may be covered by a written manufacturer warranty, a separate limited warranty issued by PRO Windows & Doors, or both.

Warranty duration, coverage, exclusions, claim procedures, available remedies, and transferability vary by product, manufacturer, system, component, and order.

Statements such as “up to 15 years” describe the maximum potential coverage available for certain products or components and do not mean that every part of every order carries identical coverage.

Unless expressly stated in a written warranty:

  • Warranty coverage does not include installation labor
  • Warranty coverage does not include removal, finishing, painting, scaffolding, lifts, access, restoration, or consequential project costs
  • Replacement components may differ slightly in appearance
  • Warranty remedies may be limited to repair, adjustment, replacement components, replacement products, or another remedy selected under the applicable warranty.

To the fullest extent permitted by law, warranties identified in the applicable written order or warranty documents are exclusive and replace other representations concerning product warranty coverage.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be disclaimed.

14. Returns, Exchanges and Cancellations

Because products are generally custom-made, they ordinarily cannot be returned, exchanged, or resold.

No return, cancellation, exchange, credit, or refund is permitted unless authorized in writing by PRO Windows & Doors.

Approved returns may be subject to:

  • Manufacturer approval
  • Inspection
  • Restocking charges
  • Freight and handling charges
  • Packaging requirements
  • Deductions for damage or missing components
  • Other conditions identified in the applicable written authorization.

Special-order, custom-sized, custom-colored, fabricated, modified, manufactured, or internationally shipped products may be noncancelable and nonrefundable after production or procurement begins.

15. Payment and Collection

Payment requirements are established in the applicable written proposal, invoice, order confirmation, or purchase agreement.

To the extent permitted by the applicable transaction documents and law, overdue amounts may result in:

Suspension of work or order processing;

Delayed manufacturing or delivery;

Storage charges;

Collection activity;

Recovery of reasonable collection costs and attorneys’ fees;

Other remedies available under contract or law.

Submission of a payment does not constitute acceptance of additional or conflicting terms printed on a check, purchase order, payment document, or customer communication unless expressly accepted in writing by an authorized representative of PRO Windows & Doors.

16. User-Submitted Materials

You may submit plans, drawings, photographs, schedules, measurements, specifications, messages, and other content through the Website.

You represent that:

  • You have the legal right and authority to submit the materials
  • The materials do not infringe another party’s rights
  • The information is accurate to the best of your knowledge
  • The materials do not contain malware or harmful code
  • Submission does not violate confidentiality or contractual obligations.

You retain ownership of your original materials.

By submitting materials, you grant PRO Windows & Doors a nonexclusive, worldwide, royalty-free license to review, reproduce, store, translate, annotate, transmit, and share those materials with employees, manufacturers, suppliers, consultants, freight providers, insurers, and other service providers as reasonably necessary to respond to your inquiry, prepare pricing, coordinate products, fulfill an order, arrange delivery, provide support, or administer warranty matters.
